Acceptance of Terms

By engaging Smarquicktways GmbH ("Company", "we", "our", or "us") for catering services or accessing our website at smarquicktways.pro, you ("Client", "you", or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website.

Company Information

Service Description

Smarquicktways provides professional catering services including:

• Corporate event catering
• Wedding and private party catering
• Food delivery services
• On-site chef services
• Equipment rental
• Event planning and coordination

Booking and Contracts

All catering services are subject to availability and confirmation by Smarquicktways. A binding contract is formed when:

• You submit a booking request
• We provide a written quotation
• You accept the quotation in writing or by payment of deposit
• We confirm the booking in writing

Pricing and Payment

All prices are quoted in Euros (EUR) and include applicable VAT unless otherwise stated. Payment terms are as follows:

• A deposit of 50% is required to confirm booking
• Final payment is due 7 days before the event date
• Late payment may result in service cancellation
• Additional charges may apply for changes made within 48 hours of the event

Cancellation Policy

Cancellation charges apply as follows:

• More than 14 days before event: 25% of total cost
• 7-14 days before event: 50% of total cost
• 3-6 days before event: 75% of total cost
• Less than 3 days before event: 100% of total cost

Client Obligations

As our client, you agree to:

• Provide accurate information about dietary requirements and allergies
• Ensure venue access and adequate facilities for service
• Provide final guest numbers 48 hours before the event
• Comply with all applicable laws and regulations
• Treat our staff with respect and professionalism

Food Safety and Allergies

Whilst we take all reasonable precautions to accommodate dietary requirements and allergies, we cannot guarantee that our food is completely free from allergens due to potential cross-contamination in our kitchens. Clients with severe allergies should inform us in advance, and we recommend consulting with our chefs about specific requirements.

Intellectual Property

All content on our website, including text, images, logos, and recipes, is the intellectual property of Smarquicktways and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

Limitation of Liability

To the maximum extent permitted by law, Smarquicktways shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability for any claim shall not exceed the total amount paid for the specific service giving rise to the claim. This limitation does not apply to death or personal injury caused by our negligence or fraud.

Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, strikes, or public health emergencies. In such cases, we will work with clients to reschedule or provide alternative arrangements where possible.

Data Protection

Governing Law

These Terms of Service are governed by Austrian law. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Klagenfurt, Austria. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Termination

We reserve the right to terminate or suspend our services immediately, without prior notice, if you breach these Terms of Service or engage in conduct that we deem inappropriate or harmful to our business or other clients. Upon termination, your right to use our services ceases immediately.

Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms. We recommend reviewing these terms periodically.

Severability
